Kelly’s Roller Skating Terms & Conditions Please read this information carefully. 1. Introduction 1.1. This page sets out the Terms & Conditions by which Kelly’s Roller Skating (“us” or “we”) agree to provide services to you and child/your organization (“you”). 1.2. When you book any service from us (“Activity”), you are signifying your agreement to these Terms and Conditions. 2. Payment, Changes or Cancellations 2.1. The cost of the Activity and valid methods of payment are discussed and agreed at the time of booking. (a) in the case of private parties or sessions, at the time of booking; and (b) in the case of parties or sessions open to the public, prior to the commencement of the Activity. 2.2. In the event of cancellations of private parties or sessions less than 7 days before the event, a charge of half the appropriate fee will be made. 2.3. We reserve the right to cancel any session, party or other service at any time up to and including the date of the Activity. Should this occur we will endeavour to give you at least 7 day’s notice where possible and we will offer you a viable alternative or a refund of any fee paid. 3. Use of Equipment and Premises 3.1. You shall be responsible for the supervision of any equipment provided by us, including roller skates and personal protective equipment (“the Equipment”), and you shall be responsible for its care, protection from damage however slight of any sort, and in the case of a private party or session, the person making the booking shall be responsible for the behaviour of all persons of all ages using the Equipment whatever their capacity. 3.2. Use of the Equipment is undertaken entirely at your own risk and you shall be deemed to have inspected the Equipment prior to use. 3.3. You shall be responsible for making yourself and those under your supervision familiar with the health and safety rules and emergency procedures which are in place at the premises in which the Activity is taking place (“the Premises”). 3.4. You accept responsibility for any damage caused to the Premises during the period of use by you or those under your supervision and you shall be liable for the costs of rectifying the damage. 3.5. We operate a No Smoking policy in all indoor areas. 3.6. Animals are not permitted onto the Premises. 4. Health and Safety 4.1. You confirm that you and those under your supervision are in proper physical condition to participate in the Activity. If you are in doubt about your ability or the ability of those under your supervision to participate in physical exercise due to a pre-existing medical condition, you should seek medical advice before doing so. 4.2. You shall inform staff of any medical condition which may affect your participation in the Activity by informing us before commencing any Activity. 2 4.3. We welcome children on the assumption that they are in good health and you shall be responsible for alerting us to any medical complaint or history suffered by the children under your supervision. 4.4. Children under the age of 16 shall be appropriately supervised at all times by a responsible adult, parent or guardian. We shall not accept responsibility for the safety of children who are not appropriately supervised. 4.5. We shall not accept liability for death or personal injury to any person save to the extent that such injury shall be caused by the negligence or default on our part. 5. Personal Property 5.1. We shall not accept responsibility or liability for any damage to or loss of any property or articles or things whatsoever placed or left by you or any other user. 5.2. Any articles handed in or found shall be placed in lost property for one month and thereafter shall be disposed of or given to a charity. 6. Complaints Complaints regarding the services and facilities provided shall be made in writing and addressed to Annette Kelly, 61 Lagmore Meadows, Dunmurry, Belfast, BT17 0TE. 7. Code of Behaviour 7.1. The following provisions apply to you and any person under your supervision: (a) You are expected to show responsible behaviour at all times during the Activity. (b) You are expected to respect the rights of other participants. (c) Alcohol must not be brought onto, or consumed on, the Premises at any time. (d) The purchase or use of any illegal substances is strictly forbidden. 7.2. In the event of a serious incident or misbehaviour, such as fighting, racial abuse, harassment, use of illegal substances or damage to property, we will insist that supervising adults, parents or guardians make arrangements to remove the children from the Premises immediately. 8. Use of Photographs You grant us permission to take and use any photographs, motion pictures, or recordings which may depict, record or refer to you or the children under your supervision for our commercial use for an unlimited period of time. You understand and accept that you will not be given a chance to receive, inspect or approve such promotional or marketing material. 9. Law & Jurisdiction 9.1. Any failure by us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. 9.2. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision and that other provisions remain in full force and effect. 9.3. Our relationship with you is subject to the laws of Northern Ireland and you and we irrevocably submit to the exclusive jurisdiction of the courts of Northern Ireland.
